Terms of service
What we promise, what we do not, and the limits of what a DNS filter can be held to.
1. Who these terms are with
NetGuard Systems Ltd, at Wenlock Studios, 50-52 Wharf Road, London N1 7EU. Using this website or the hosted resolver means accepting these terms.
2. What the service is
A DNS resolver that declines to resolve domains on lists you enable, and a website describing it. It is a filtering tool. It is not a treatment programme, a self-exclusion scheme, or a guarantee of any outcome.
3. What it explicitly is not
We do not promise the filter cannot be bypassed, because it can. The documented limitations form part of these terms. If you are relying on this to protect someone at risk, read that page and register with GAMSTOP as well.
4. Acceptable use
- Do not use the hosted resolver to filter a network you do not administer or have permission to administer.
- Do not attempt to overload the service, and do not attempt to access accounts other than your own.
- Security testing within the scope of the disclosure policy is welcome and is not a breach of these terms.
5. Accounts
You are responsible for keeping your password to yourself. Tell us at once if you think an account has been accessed by someone else. We may suspend an account that is being used to abuse the service, and we will tell you why.
6. Payment and cancellation
The hosted plan is billed monthly in advance. Cancel at any time from the dashboard; the service runs to the end of the period you have paid for and is not renewed. There is no minimum term and no cancellation fee. If we increase the price we will tell you at least thirty days beforehand.
7. Availability
We aim for the hosted resolver to be continuously available and we do not offer a contractual uptime guarantee, because two people running a small service cannot honestly back one. Configure a secondary resolver. The status page reports what we can see.
8. Your data
Governed by the privacy policy, which forms part of these terms.
9. Liability
We do not exclude liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. Subject to that, our liability is limited to the amount you paid us in the twelve months before the claim, and we are not liable for losses arising from gambling that took place despite, around, or because of a failure of the filter.
This is not us being evasive. A filter that can be turned off from a settings screen cannot carry responsibility for what someone does after turning it off.
10. Ending it
You may stop using the service at any time. We may end an account for a serious or repeated breach of section 4, with notice and with a reason. If we withdraw the hosted service entirely, we will give ninety days' notice, refund the unused part of any payment, and the self-hosted version will remain available.
11. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer, this does not affect your statutory rights.
12. Changes
Changes are announced in the changelog at least thirty days before they take effect for existing customers.
